Features of the “Consorzio Ordinario di Operatori Economici”
Our Consortium, in accordance with the law in force and, and in particular, based on the law of the Dlgs. 50/2016, belongs to the category of multiple subjects or with multiple suitability, defined by the law “consorzio ordinario di operatori economici” in accordance with the law 2602 c.c. [art. 45, comma 2, lett. e) del Codice dei contratti pubblici], to which the disposition of the law 48 of the same Code used for the temporary grouping must be appplied.
The “consorzi ordinari di operatori economici” cannot have an owned qualification and so, for example, they join the challenges by using all of the qualifications of the other consortium partners (TAR Bologna, sez. I, 13 febbraio 2003, n. 97).

Ai consorzi ordinari di concorrenti di cui all’articolo 2602 codice civile, costituiti in forma di società consortile (ex articolo 2615-ter cod. civ.), in quanto soggetti giuridici con idoneità plurisoggettiva, si applicano le disposizioni previste per le associazioni temporanee di imprese, in virtù del rinvio operato dall’articolo 34, comma 1, lettera e) del d. Lgs. n. 163/2006 al successivo articolo 37.
